Personal Data Processing Conditions

The Seller hereby provides the Buyer, regarding the processing of the Buyer's personal data as an individual whose personal data is being processed (hereinafter referred to as the “data subject”), with information pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as “GDPR”) and Act No. 18/2018 Coll. on the protection of personal data.

Purpose of processing personal data by GUPOL, s.r.o.:
To process the Buyer's order and perform the rights and obligations arising from the contractual relationship between the Buyer and the Seller, to operate the online store and the Website and related information systems of the Seller, and to keep records of purchase contracts and invoices.

When placing an order, personal data required for the successful fulfillment of the order and purchase contract (name and surname/company name, company ID, billing address including postal code, delivery address including postal code, phone number, and email address) are requested. Providing personal data is necessary to fulfill the Buyer's order, complete and close the purchase contract, and deliver the goods to the Buyer.

The purpose of processing personal data also includes your consent to processing for direct marketing purposes (sales support), such as marketing offers, newsletters, catalog mailings, commercial communications, product and news information, and newsletter mailings according to Article 6(1)(a) GDPR, if no goods or services were ordered and this consent was given by checking the appropriate box on the Seller's website. Consent can be withdrawn by unsubscribing from direct marketing at info@abouther.sk or directly on our website where you provided consent or by sending a request to the contact information listed at the beginning of this Appendix No. 1 to the Conditions. In the event of withdrawal of consent, the Seller is obligated to promptly delete the data.

Legal basis for processing personal data:
The legal basis for processing personal data is according to Article 6(1)(b) GDPR and Section 13(1)(b) of the Act: the Buyer's order, the conclusion of a purchase contract between the Buyer and the Seller, the delivery of the ordered goods to the Buyer, and other obligations (rights and duties) arising from the purchase contract.

Personal data may be provided to the following categories of recipients or institutions:
- Persons authorized to perform activities for GUPOL, s.r.o., involved in fulfilling the Buyer's order and the purchase contract (delivery of goods/payment processing based on the contract).
- Web hosting providers and companies through which we send our marketing messages.
- Other entities providing services related to the operation of the online store and the Website and related information systems of the Seller and other services in connection with operating the Website.

 Transfer of personal data to a third country:
GUPOL, s.r.o., as the data controller, does not intend to transfer personal data to a country outside the EEA and/or provide it to an international organization.

Duration of personal data retention:
GUPOL, s.r.o. is authorized to process the personal data of data subjects:
- For the duration specifically determined by the relevant legal regulations,
- For the duration of the processing purpose,
- Until consent to processing for direct marketing purposes is revoked, for a maximum of 5 years if personal data are processed based on consent.

As a data subject, you have the following rights:
- The right to request access to your personal data from GUPOL, s.r.o.
- The right to correct personal data
- The right to delete personal data
- The right to restrict the processing of personal data
- The right to object to the processing of personal data
- The right to data portability
- The right to lodge a complaint with the supervisory authority, which is the Office for Personal Data Protection of the Slovak Republic.

These rights of the data subject are further specified in Articles 15 to 21 of the GDPR. The data subject exercises these rights in accordance with the GDPR and other applicable legal regulations. The data subject can exercise their rights against GUPOL, s.r.o. through a written request or electronically, by sending a written request to the address: GUPOL, s.r.o., Smetanova 1655/7, 911 01 Trenčín, Company ID: 55 748 244, or by email to: osobneudaje@abouther.sk. If the data subject requests it, the Seller can also provide information orally, provided the data subject proves their identity in another way.

 Appendix No. 2 to the Conditions

What are cookies?
Our online store's websites (hereinafter referred to as "our sites") use cookies. Cookies are small files that websites offer to a visitor's browser for storage as a means to enhance the user experience when browsing these sites. Cookies contain a string of letters and numbers and take up very little space on the computer's hard drive. They persist on the user's computer until the expiration date (which is set by the websites that store them) and are automatically deleted after this term. During each visit to the sites, the information stored in cookies from previous visits is read, thus allowing the visitor to be identified and display, for example, the settings they used last time or fill in forms for them so they do not have to fill them out repeatedly.

Our sites use these types of cookies:
1. **Necessary for basic functionality**:
   These are used to identify the visitor by a specific string (they do not contain personal data), to remember items placed in the cart, consent to the use of cookies, and consent to receive offers and news via email. We use these cookies without your consent, but you can disable their storage in your browser. However, if you do so, our sites will not function correctly for you (e.g., you will not be able to place an order).

2. **Statistical**:
   These collect information about how visitors use the sites (e.g., which subpages are visited the most, how long visitors stay on them, what devices and browsers visitors use, testing new features). The data collected is usually used to improve the functioning of the sites both technically and content-wise. Storing statistical cookies on our sites is mediated by third-party applications (Google Analytics, Exponea, Hotjar).

3. **For advanced functionality**:
   Functionality such as long-term storage of user settings (chat, reviews, discount coupons) is ensured by this group of cookies. On our sites, we use third-party applications for this purpose (Google, Facebook, Exponea, Dognet, Livechatoo, Chatisto).

4. **Marketing**:
   These cookies apply targeted advertising. If enabled, the advertising you see on other websites will be selected based on what you were previously interested in and also ensure that ads you have already seen do not appear too often and evaluate their effectiveness. We allow third parties, mainly advertising and social networks (Google AdWords, Facebook, Adform), to use these cookies on our sites. They do not contain personal data.

5. **Local Storage**:
   Local Storage is not cookies in the true sense but works similarly and can be used for the same purposes. Our sites store keys for Exponea and Optimizely services in local storage.
